If one of the parties so requests, any dispute relating to the application of Articles L. 611-7 and L. 611-7-1 shall be submitted to a joint conciliation commission, chaired by a magistrate of the judiciary whose vote shall be decisive in the event of a tie.
Within six months of its referral, this commission, set up at the Institut national de la propriété industrielle, will draw up a conciliation proposal; this will be deemed to be an agreement between the parties, if, within one month of its notification, one of them has not referred the matter to the competent court sitting in chambers. This agreement may be rendered enforceable by order of the president of the judicial court to which the most diligent party makes a simple application.
The parties may appear themselves before the commission and be assisted or represented by a person of their choice.
The commission may be assisted by experts it appoints for each case.
The detailed rules for the application of this article, which include special provisions for the agents referred to in the last paragraph of Article L. 611-7 and for the natural persons covered by Article L. 611-7-1, shall be laid down by decree in the Conseil d’Etat after consultation with the professional organisations and trade unions concerned.
