A decision to surrender to the competent authorities of a Member State of the European Union may be issued to foreign students and foreign researchers and their family members, admitted to reside in the territory of this State and benefiting from mobility in France in accordance with Directive (EU) 2016/801 of the European Parliament and of the Council of 11 May 2016 on the conditions of entry and residence of third-country nationals for the purposes of research, study, training, voluntary service and pupil exchange programmes or educational projects and au pair work, where this foreign national is in one of the following situations:
1° The residence permit has expired or has been withdrawn by the State which issued it, during the period of mobility;
2° The foreign national does not meet or no longer meets the conditions for mobility;
3° The administrative authority has not received notification of the foreign national’s intention to carry out mobility on French territory;
4° The administrative authority has objected to the foreign national’s mobility.
