Screening for transmissible infectious diseases by means of a rapid diagnostic test may be carried out on a minor by staff from the structures mentioned in the third paragraph of article L. 6211-3.
Notwithstanding article 371-1 of the Civil Code , the staff mentioned in the first paragraph of this article may dispense with obtaining the consent of the holder(s) of parental authority when this screening is necessary to safeguard the health of a minor who expressly opposes consultation with the holder(s) of parental authority in order to keep his/her state of health secret. However, such staff must first endeavour to obtain the minor’s consent to such consultation. If the minor maintains his or her opposition, the staff may carry out the screening. In this case, the minor must be accompanied by an adult of his or her choice.
