Article L6212-3 of the French General Code of Local Authorities

I. – The representative of the State may take any measures relating to the maintenance of public health, safety and tranquillity.

If the maintenance of order is threatened, the representative of the State may substitute himself, by reasoned decree, for the president of the territorial council for the repression of offences against public tranquillity, for the maintenance of public order and for the policing of bathing and nautical activities.

II. – Subject to the provisions of the Code of Criminal Procedure relating to the exercise of the judicial police mission and the provisions of the General Code of Local Authorities relating to crime prevention, the representative of the State in Saint-Barthélemy leads and coordinates all internal security arrangements.

To this end, without prejudice to the missions of the gendarmerie falling within the scope of national defence, he/she determines the missions other than those relating to the exercise of the judicial police and coordinates the action of the various services and forces available to the State in terms of internal security.

He/she directs the action of the services of the national police and the units of the national gendarmerie in terms of public order and administrative policing. In compliance with military status as far as the national gendarmerie is concerned, the head of the national gendarmerie command and his equivalent for the national police are placed under his authority and report to him on the execution and results of their missions in these matters.

Article L6212-3

I. – Le représentant de l’Etat peut prendre toutes mesures relatives au maintien de la salubrité, de la sûreté et de la tranquillité publiques.

Si le maintien de l’ordre est menacé, le représentant de l’Etat peut se substituer, par arrêté motivé, au président du conseil territorial pour la répression des atteintes à la tranquillité publique, pour le maintien de l’ordre public et pour la police des baignades et des activités nautiques.

II. – Sous réserve des dispositions du code de procédure pénale relatives à l’exercice de la mission de police judiciaire et des dispositions du code général des collectivités territoriales relatives à la prévention de la délinquance, le représentant de l’Etat à Saint-Barthélemy anime et coordonne l’ensemble du dispositif de sécurité intérieure.

A cet effet, sans préjudice des missions de la gendarmerie relevant de la défense nationale, il fixe les missions autres que celles qui sont relatives à l’exercice de la police judiciaire et coordonne l’action des différents services et forces dont dispose l’Etat en matière de sécurité intérieure.

Il dirige l’action des services de la police nationale et des unités de la gendarmerie nationale en matière d’ordre public et de police administrative. Dans le respect du statut militaire pour ce qui concerne la gendarmerie nationale, le responsable du commandement de la gendarmerie nationale et son équivalent pour la police nationale sont placés sous son autorité et lui rendent compte de l’exécution et des résultats de leurs missions en ces matières.
