Article L6222-3 of the French Public Health Code

The Director General of the Regional Health Agency may object, on grounds relating to the risk of jeopardising the continuity of medical biology services, to the acquisition of a medical biology laboratory or a medical biology laboratory site, to the purchase of all or part of the assets of a company operating a medical biology laboratory or to a merger of medical biology laboratories, including the transfer of all assets and liabilities, where this transaction would result in the proportion of the total number of medical biology examinations carried out by the laboratory resulting from this acquisition or merger exceeding the threshold of 25% of the total number of medical biology examinations carried out in the area determined pursuant to b of 2° of Article L. 1434-9 in question, the share of medical biology examinations performed by the laboratory resulting from this acquisition or merger exceeds the threshold of 25% of the total number of medical biology examinations performed.

Le directeur général de l’agence régionale de santé peut s’opposer, pour des motifs tenant au risque d’atteinte à la continuité de l’offre de biologie médicale, à une opération d’acquisition d’un laboratoire de biologie médicale, d’un site de laboratoire de biologie médicale, à une opération de rachat de tout ou partie d’actifs d’une société exploitant un laboratoire de biologie médicale ou à une opération de fusion de laboratoires de biologie médicale y compris la transmission universelle de patrimoine, lorsque cette opération conduirait à ce que, sur la zone déterminée en application du b du 2° de l’article L. 1434-9 considérée, la part réalisée par le laboratoire issu de cette acquisition ou de cette fusion dépasse le seuil de 25 % du total des examens de biologie médicale réalisés.
