Article L6224-10 of the French General Code of Local Authorities

The local authority is subrogated to the rights of the victim to obtain from the perpetrators of the offences referred to in article LO 6224-9 the return of sums paid to the elected representative concerned. It also has a direct action for the same purposes, which it may bring before the criminal courts, if necessary by bringing a civil action.

Article L6224-10

La collectivité est subrogée aux droits de la victime pour obtenir des auteurs des infractions visées à l’article LO 6224-9 la restitution des sommes versées à l’élu intéressé. Elle dispose en outre, aux mêmes fins, d’une action directe qu’elle peut exercer, au besoin par voie de constitution de partie civile, devant la juridiction pénale.
