In the light of the economic, social and, where applicable, environmental assessment, the debtor, with the assistance of the administrator, shall propose a plan, without prejudice to the application of the provisions of Article L. 622-10.
The draft plan mentions the commitments to make cash contributions made for the implementation of the plan.
The draft plan determines the prospects for recovery based on the possibilities and terms of business, the state of the market and the available means of financing.
It defines the terms of settlement of liabilities and any guarantees that the debtor must take out to ensure performance.
This draft sets out and justifies the level and prospects of employment as well as the social conditions envisaged for the continuation of business. Where the project provides for redundancies for economic reasons, it recalls the measures already taken and defines the actions to be taken to facilitate the redeployment and compensation of employees whose jobs are threatened. The project shall take account of the work identified in the environmental report.
It shall list, append and analyse the offers to acquire one or more businesses presented by third parties. It indicates the activity or activities proposed for closure or addition.
