In the event of the sale of a property subject to a special security interest or a legal mortgage, the proportion of the price corresponding to the claims secured by these security interests shall be paid into a deposit account at the Caisse des dépôts et consignations and the creditors benefiting from these security interests or holding a general lien shall be paid out of the price after payment of the claims secured by the lien established in articles L. 3253-2 to L. 3253-4, L. 742-6 and L. 7313-8 of the Labour Code.
They receive the dividends due according to the plan, reduced according to the advance payment, according to the order of preference existing between them.
If an asset is encumbered by a special real security or a legal mortgage, another guarantee may be substituted for it if necessary, if it offers equivalent advantages. In the absence of agreement, the court may order this substitution.
