Article L628-5 of the French Commercial code

The Public Prosecutor shall refer the matter to the court for the purpose of terminating the accelerated safeguard procedure if it is established that the debtor had been in cessation of payments for more than forty-five days when it sent or delivered the petition referred to in Article L. 611-6.

Le ministère public saisit le tribunal à l’effet de mettre fin à la procédure de sauvegarde accélérée s’il est établi que le débiteur se trouvait en cessation des paiements depuis plus de quarante-cinq jours lorsqu’il a adressé ou remis la requête mentionnée à l’article L. 611-6.
