Article L631-16 of the French Commercial code

If, during the observation period, it appears that the debtor has sufficient funds to pay off the creditors and the costs and debts relating to the proceedings, the court may terminate the proceedings.

It shall rule at the request of the debtor, under the conditions provided for in the second paragraph of II of Article L. 631-15.

Article L631-16

S’il apparaît, au cours de la période d’observation, que le débiteur dispose des sommes suffisantes pour désintéresser les créanciers et acquitter les frais et les dettes afférents à la procédure, le tribunal peut mettre fin à celle-ci.

Il statue à la demande du débiteur, dans les conditions prévues au deuxième alinéa du II de l’article L. 631-15.
