Article L631-20 of the French Commercial code

Notwithstanding the provisions of the third paragraph of Article L. 626-27, if the debtor’s payments cease during the implementation of the plan, the court that approved the plan decides, after receiving the opinion of the Public Prosecutor’s Office, to terminate the plan and initiate judicial liquidation proceedings. Before making its decision, the court shall examine whether the debtor’s situation meets the conditions laid down in articles L. 645-1 and L. 645-2 and shall, where appropriate, with the debtor’s agreement, open a professional recovery procedure.

Par dérogation aux dispositions du troisième alinéa de l’article L. 626-27, lorsque la cessation des paiements du débiteur est constatée au cours de l’exécution du plan, le tribunal qui a arrêté ce dernier décide, après avis du ministère public, sa résolution et ouvre une procédure de liquidation judiciaire. Avant de statuer, le tribunal examine si la situation du débiteur répond aux conditions posées aux articles L. 645-1 et L. 645-2 et ouvre, le cas échéant, avec son accord, une procédure de rétablissement professionnel.
