At the request of the administrator, the court may order the total or partial sale of the business if the proposed plan or plans appear manifestly unsuitable for the recovery of the business or in the absence of such plans. The provisions of Section 1 of Chapter II of Title IV, with the exception of I of Article L. 642-2, and Article L. 642-22 shall apply to such assignment. The mandataire judiciaire shall perform the duties devolved to the liquidator.
The administrator shall remain in office to perform all acts necessary to complete the assignment.
Where the total or partial assignment has been ordered pursuant to the first paragraph, the procedure shall be continued within the limits provided by Article L. 631-7. If it is not possible to draw up a recovery plan, the court shall order the judicial liquidation and terminate the observation period and the administrator’s assignment, subject to the provisions of Article L. 641-10. Assets not included in the disposal plan are then disposed of under the conditions of Section 2 of Chapter II of Title IV.
