Article L6312-2 of the French General Code of Local Authorities

The State representative directs the State services in Saint-Martin, subject to the exceptions listed exhaustively by decree in the Council of State. He alone is empowered to speak on behalf of the State before the Territorial Council and to commit the State to the collectivity.

Unless otherwise provided for by the present book, he exercises the powers devolved to the representative of the State in the départements and regions.

Le représentant de l’Etat dirige les services de l’Etat à Saint-Martin, sous réserve des exceptions limitativement énumérées par décret en Conseil d’Etat. Il est seul habilité à s’exprimer au nom de l’Etat devant le conseil territorial et à engager l’Etat envers la collectivité.

S’il n’en est disposé autrement par le présent livre, il exerce les compétences dévolues au représentant de l’Etat dans les départements et les régions.
