Article L6312-5 of the French Public Health Code

The following are determined by decree in the Conseil d’Etat:

-the conditions for approval of any person carrying out medical transport as provided for in article L. 6312-2 ;

the conditions under which the theoretical number of vehicles referred to in article L. 6312-4 is set, as well as the conditions for issuing, transferring and withdrawing authorisations to put into service, in particular with regard to approval; – the categories of means of transport assigned to medical transport; – the conditions under which any person carrying out medical transport must be approved;

-the categories of means of transport used for medical transport;

-the categories of persons authorised to carry out medical transport, their respective duties and the qualifications and composition of crews;

-the procedures for the issue by the regional health agency to the persons mentioned in article L. 6312-2 of authorisation to carry out medical transport and the procedures for its withdrawal;

the obligations of these persons with regard to the on-call service organised by the regional health agency and with regard to the call reception and regulation centres mentioned in article L. 6112-5;

the conditions under which the regional health agency organises the departmental on-call service ensuring the availability of medical transport.

Article L6312-5

Sont déterminées par décret en Conseil d’Etat :

-les conditions d’agrément de toute personne effectuant un transport sanitaire prévu à l’article L. 6312-2 ;

-les conditions dans lesquelles le nombre théorique de véhicules mentionné à l’article L. 6312-4 est fixé, ainsi que les conditions de délivrance, de transfert et de retrait des autorisations de mise en service, notamment au regard de l’agrément ;

-les catégories de moyens de transport affectés aux transports sanitaires ;

-les catégories de personnes habilitées à effectuer des transports sanitaires, leurs missions respectives ainsi que la qualification et la composition des équipages ;

-les modalités de délivrance par l’agence régionale de santé aux personnes mentionnées à l’article L. 6312-2 de l’agrément pour effectuer des transports sanitaires ainsi que les modalités de son retrait ;

-les obligations de ces personnes à l’égard du service de garde organisé par l’agence régionale de santé et à l’égard des centres de réception et de régulation des appels mentionnés à l’article L. 6112-5 ;

-les conditions dans lesquelles l’agence régionale de santé organise la garde départementale assurant la permanence du transport sanitaire.
