I. – Market infrastructures that disseminate or make available to the Autorité des marchés financiers or the Autorité de contrôle prudentiel et de résolution information relating to transactions in financial instruments may communicate to their foreign counterparts and to the counterpart authorities of the Autorité des marchés financiers or the Autorité de contrôle prudentiel et de résolution the information necessary for the performance of their duties, including information covered by professional secrecy, provided that these counterpart bodies are themselves subject to professional secrecy within a legislative framework offering guarantees equivalent to those applicable in France and subject to reciprocity.
Where such exchanges of information take place between market infrastructures and counterpart authorities of the Autorité des marchés financiers or the Autorité de contrôle prudentiel et de résolution, they shall be carried out under the conditions laid down in a cooperation agreement referred to in Article L. 632-7.
For the purpose of monitoring the risks incurred by the members, this information may in particular cover positions taken on the market, guarantee or margin deposits and their composition, as well as margin calls.
A decree defines the market infrastructures subject to these provisions.
II.Credit institutions and investment firms that are subject to supervision by the Autorité des marchés financiers and the Autorité de contrôle prudentiel et de résolution may, under the conditions set out in a cooperation agreement referred to in Article L. 632-7, subject to reciprocity, communicate to the counterpart authorities of the Autorité des marchés financiers or the Autorité de contrôle prudentiel et de résolution the information necessary for the performance of their duties, including information covered by professional secrecy, provided that these counterpart authorities are themselves subject to professional secrecy within a legislative framework offering guarantees equivalent to those applicable in France.
