Notwithstanding the provisions of Law 68-678 of 26 July 1968 on the disclosure of economic, commercial, industrial, financial or technical documents and information to foreign natural or legal persons, the Autorité de contrôle prudentiel et de résolution and the Autorité des marchés financiers shall cooperate with the European Securities and Markets Authority, established by Regulation (EU) No 1095/2010 of the European Parliament and of the Council of 24 November 2010 establishing a European Supervisory Authority (European Securities and Markets Authority), the European Banking Authority established by Regulation (EU) No 1093/2010 of the European Parliament and of the Council of 24 November 2010 establishing a European Supervisory Authority (European Banking Authority), the European Insurance and Occupational Pensions Authority, established by Regulation (EU) No 1094/2010 of the European Parliament and of the Council of 24 November 2010 establishing a European Supervisory Authority (European Insurance and Occupational Pensions Authority) and the European Systemic Risk Board, established by Regulation (EU) No 1092/2010 of the European Parliament and of the Council, of 24 November 2010 on Community macro-prudential oversight of the financial system and establishing a European Systemic Risk Board, and shall exchange with them, without undue delay, information relevant to the performance of their tasks, in accordance with the conditions laid down in the regulations establishing them. The Autorité de contrôle prudentiel et de résolution and the Autorité des marchés financiers may, for this purpose, transmit information covered by professional secrecy.
The conditions for application of this article shall be laid down by decree in the Conseil d’Etat.
