Article L633-3 of the French Monetary and Financial Code

Where it is designated as coordinator, the Autorité de contrôle prudentiel et de résolution shall ensure, as part of the supplementary supervision :

a) the coordination of the gathering and dissemination of all information relevant in the normal course of business as well as in emergency situations, and in particular any important information relevant to the prudential supervision exercised by a competent authority under sectoral rules ;

b) Prudential supervision and assessment of the financial situation of a financial conglomerate;

c) the assessment of the application of the rules on capital adequacy, risk concentration and transactions between the different entities of the conglomerate in accordance with the provisions of Article L. 517-8;

d) the assessment of the structure, organisation and internal control systems of the financial conglomerate;

e) the planning and co-ordination of supervisory activities in co-operation with the competent authorities concerned.

It may subject the financial conglomerate to crisis simulation exercises in cooperation with the competent authorities concerned.

Article L633-3

Lorsqu’elle est désignée comme coordonnateur, l’Autorité de contrôle prudentiel et de résolution assure, au titre de la surveillance complémentaire :

a) La coordination de la collecte et de la diffusion de toute information utile dans la marche normale des affaires comme dans les situations d’urgence, et en particulier de toute information importante intéressant la surveillance prudentielle exercée par une autorité compétente en vertu des règles sectorielles ;

b) Le contrôle prudentiel et l’évaluation de la situation financière d’un conglomérat financier ;

c) L’évaluation de l’application des règles relatives à l’adéquation des fonds propres, à la concentration de risques et aux transactions entre les différentes entités du conglomérat conformément aux dispositions de l’article L. 517-8 ;

d) L’évaluation de la structure, de l’organisation et des dispositifs de contrôle interne du conglomérat financier ;

e) La planification et la coordination des activités prudentielles, en coopération avec les autorités compétentes concernées.

Elle peut soumettre le conglomérat financier à des exercices de simulation de crise, en coopération avec les autorités compétentes concernées.
