Article L634-4 of the French Monetary and Financial Code

Natural persons implicated in an alert sent to the Autorité des marchés financiers or the Autorité de contrôle prudentiel et de résolution in respect of a breach mentioned in Article L. 634-1 may not be subject to a measure mentioned in the first paragraph of Article L. 634-3 for the sole reason that they have been the subject of such an alert.

Any decision taken in disregard of the first paragraph of this article is automatically null and void.

Article L634-4

Les personnes physiques mises en cause par un signalement adressé à l’Autorité des marchés financiers ou à l’Autorité de contrôle prudentiel et de résolution au titre d’un manquement mentionné à l’article L. 634-1 ne peuvent faire l’objet, au seul motif qu’elles ont fait l’objet d’un tel signalement, d’une mesure mentionnée au premier alinéa de l’article L. 634-3.

Toute décision prise en méconnaissance du premier alinéa du présent article est nulle de plein droit.
