Article L6363-1 of the French Labour Code

The labour inspectors referred to in article L. 8112-1, together with the vocational training inspectors and category A civil servants placed under the authority of the Minister responsible for vocational training, authorised under the conditions laid down by decree in the Conseil d’Etat, may investigate and draw up official reports on the offences provided for in articles L. 6355-1 to L. 6355-22, L. 6355-24 and L. 6363-2.

Checks are carried out under the conditions laid down in this Title.

The Public Prosecutor is informed in advance of the operations envisaged if an offence is being investigated. He may oppose these operations.

Reports are sent to the Public Prosecutor within five days of being drawn up. A copy is given to the person concerned.

Article L6363-1

Les agents de contrôle de l’inspection du travail mentionnés à l’article L. 8112-1, concurremment avec les inspecteurs de la formation professionnelle et les agents de la fonction publique de l’Etat de catégorie A placés sous l’autorité du ministre chargé de la formation professionnelle, habilités dans des conditions prévues par décret en Conseil d’Etat, peuvent rechercher et constater par procès-verbal les infractions prévues aux articles L. 6355-1 à L. 6355-22, L. 6355-24 et L. 6363-2.

Les contrôles s’exercent dans les conditions prévues au présent titre.

Le procureur de la République est préalablement informé des opérations envisagées en cas de recherche d’une infraction. Il peut s’opposer à ces opérations.

Les procès-verbaux lui sont transmis dans les cinq jours suivant leur établissement. Une copie est remise à l’intéressé.
