Article L6522-3 of the French Labour Code

For its application in Guadeloupe, Guyana, Martinique, Mayotte, La Réunion, Saint-Barthélemy, Saint-Martin and Saint-Pierre-et-Miquelon, II of article L. 6211-3 is worded as follows:

“II – The amount of operating and investment expenditure committed and mandated as mentioned in I of this article, as well as a detailed statement of their allocation, are the subject of an annual debate in the Regional Council on the basis of a report presented by the President of the Regional Council. This debate may also cover other expenditure incurred by the region in relation to apprenticeships. The report, which includes an appendix showing the amounts of expenditure committed and mandated and a detailed statement of their allocation, is sent for information to the State representative in the region and to France Compétences. The resources allocated to the region for the capital expenditure mentioned in 2° of the same I are determined and distributed on the basis of the capital expenditure recorded for the 2017 and 2018 financial years, or, in the absence of capital expenditure made over this period in the overseas territories, according to a minimum amount defined by decree. “

Pour son application en Guadeloupe, en Guyane, en Martinique, à Mayotte, à La Réunion, à Saint-Barthélemy, à Saint-Martin et à Saint-Pierre-et-Miquelon le II de l’article L. 6211-3 est ainsi rédigé :

“ II.-Le montant des dépenses engagées et mandatées en matière de fonctionnement et d’investissement mentionnées au I du présent article ainsi qu’un état détaillé de leur affectation font l’objet d’un débat annuel en conseil régional sur la base d’un rapport présenté par le président du conseil régional. Ce débat peut également porter sur les autres dépenses engagées par la région en matière d’apprentissage. Le rapport, comprenant une annexe présentant les montants des dépenses engagées et mandatées et l’état détaillé de leur affectation, est transmis pour information au représentant de l’Etat dans la région et à France compétences. Les ressources allouées à la région pour les dépenses d’investissement mentionnées au 2° du même I sont déterminées et réparties sur la base des dépenses d’investissement constatées au titre des exercices 2017 et 2018, ou, à défaut de dépenses d’investissement réalisées sur cette période dans les territoires d’outre-mer, en fonction d’un montant minimum défini par décret. “
