Article L670-5 of the French Commercial code

Other than the cases provided for in Article L. 643-11, creditors also recover their right to take individual legal action against the debtor where the court finds, of its own motion or at the request of the commissaire, that the contribution referred to in Article L. 670-4.

Outre les cas prévus à l’article L. 643-11, les créanciers recouvrent également leur droit de poursuite individuelle à l’encontre du débiteur lorsque le tribunal constate, d’office ou à la demande du commissaire, l’inexécution de la contribution visée à l’article L. 670-4.
