Article L680-6 of the French Commercial code

The judgment opening safeguard, legal redress or legal liquidation proceedings automatically entails, until the closure of the proceedings or, where applicable, until the end of the operations of the plan, a prohibition on any debtor from allocating to a professional activity any property included in the assets covered by the proceedings or, subject to the payment of the income mentioned in Article L. 526-18, to change the allocation of such property, where this would result in a reduction in the assets of this estate.

Any act carried out in breach of the provisions of this article shall be annulled at the request of any interested party or the Public Prosecutor within three years of its date.

Le jugement d’ouverture d’une procédure de sauvegarde, de redressement judiciaire ou de liquidation judiciaire emporte, de plein droit, jusqu’à la clôture de la procédure ou, le cas échéant, jusqu’à la fin des opérations du plan, interdiction pour tout débiteur d’affecter à une activité professionnelle un bien compris dans le patrimoine visé par la procédure ou, sous réserve du versement des revenus mentionnés à l’article L. 526-18, de modifier l’affectation d’un tel bien, lorsqu’il en résulterait une diminution de l’actif de ce patrimoine.


Tout acte passé en violation des dispositions du présent article est annulé à la demande de tout intéressé ou du ministère public dans le délai de trois ans à compter de sa date.
