Article L694-3 of the French Commercial code

The court which has ordered the opening of the collective coordination proceedings shall decide on the coordinator’s request submitted in accordance with paragraph 6 of Article 72 of the Regulation and on the final statement drawn up pursuant to Article 77 of that Regulation. Article L. 663-1 shall not apply.

The judgment on the final declaration may be appealed by any insolvency practitioner who has participated in the collective coordination proceedings and raised an objection, as well as by the debtor who has not been divested and the public prosecutor.

Le tribunal qui a prononcé l’ouverture de la procédure de coordination collective statue sur la demande du coordinateur présentée conformément au paragraphe 6 de l’article 72 du règlement et sur la déclaration finale établie en application de l’article 77 de ce règlement. L’article L. 663-1 n’est pas applicable.


Le jugement rendu sur la déclaration finale peut faire l’objet d’un appel de la part de tout praticien de l’insolvabilité ayant participé à la procédure de coordination collective et élevé une objection ainsi que de la part du débiteur non dessaisi et du ministère public.
