Article L711-20 of the French Commercial code

The staff representatives on the works councils of the consular higher education establishments are elected from lists drawn up by the trade union organisations for each college. The committees comprise the following three colleges:

1° The college of workers and employees;

2° The college of engineers, heads of department, technicians, supervisors and similar;

3° The college of teachers.

Article L. 2324-11 and the second paragraph of Article L. 2324-12 of the Labour Code do not apply to these committees.

As an exception to articles L. 2327-4 and L. 2327-5 of the same code, in the event of the creation of works councils and a central works council in accordance with article L. 2327-1 of the said code, each works council within which there is a college of teaching staff is represented on the central works council by at least one full delegate and one deputy delegate from this college.

Les représentants du personnel aux comités d’entreprise des établissements d’enseignement supérieur consulaire sont élus sur des listes établies par les organisations syndicales pour chaque collège. Les comités comprennent les trois collèges suivants :

1° Le collège des ouvriers et employés ;

2° Le collège des ingénieurs, chefs de service, techniciens, agents de maîtrise et assimilés ;

3° Le collège des enseignants.

L’article L. 2324-11 et le deuxième alinéa de l’article L. 2324-12 du code du travail ne sont pas applicables à ces comités.

Par dérogation aux articles L. 2327-4 et L. 2327-5 du même code, en cas de constitution de comités d’établissement et d’un comité central d’entreprise conformément à l’article L. 2327-1 dudit code, chaque comité d’établissement au sein duquel il existe un collège du personnel enseignant est représenté au sein du comité central d’entreprise par au moins un délégué titulaire et un délégué suppléant issus de ce collège.
