In addition to the penalties provided for in articles L. 716-9 and L. 716-10, the court may order the total or partial, definitive or temporary closure, for a maximum period of five years, of the establishment used to commit the offence.
Temporary closure may not result in the termination or suspension of the employment contract or in any financial prejudice to the employees concerned. When permanent closure results in the dismissal of staff, it shall give rise, in addition to compensation in lieu of notice and compensation for dismissal, to the damages and interest provided for in articles L. 1235-2 to L. 1235-5 and L. 1235-11 to L. 1235-13 of the Labour Code in the event of termination of an employment contract. Failure to pay this compensation is punishable by six months’ imprisonment and a fine of €3,750.
