Article L721-4 of the French Commercial code

The commercial court hears promissory notes bearing the signatures of both traders and non-traders at the same time.

However, it is obliged to refer to the judicial court if it is requested to do so by the defendant where the promissory notes bear only the signatures of non-traders and do not arise from trade, traffic, exchange, banking or brokerage transactions.

Le tribunal de commerce connaît des billets à ordre portant en même temps des signatures de commerçants et de non-commerçants.

Toutefois, il est tenu de renvoyer au tribunal judiciaire s’il en est requis par le défendeur lorsque les billets à ordre ne portent que des signatures de non-commerçants et n’ont pas pour occasion des opérations de commerce, trafic, change, banque ou courtage.
