Article L722-6-2 of the French Commercial code

The office of commercial court judge is incompatible with holding office as a representative in the European Parliament.

It is also incompatible with holding office as a regional councillor, departmental councillor, municipal councillor, arrondissement councillor, Paris councillor, Lyon metropolitan councillor, councillor to the Corsican Assembly, councillor to the Guiana Assembly or councillor to the Martinique Assembly, within the jurisdiction of the court in which the person concerned holds office.

Le mandat de juge de tribunal de commerce est incompatible avec l’exercice d’un mandat de représentant au Parlement européen.


Il est également incompatible avec l’exercice d’un mandat de conseiller régional, de conseiller départemental, de conseiller municipal, de conseiller d’arrondissement, de conseiller de Paris, de conseiller métropolitain de Lyon, de conseiller à l’Assemblée de Corse, de conseiller à l’assemblée de Guyane ou de conseiller à l’assemblée de Martinique, dans le ressort de la juridiction dans laquelle l’intéressé exerce ses fonctions.
