Article L752-21 of the French Commercial code

An applicant whose project has been rejected on substantive grounds by the National Commission for Commercial Development may not submit a new application for authorisation on the same plot of land, unless he has taken into account the reasons for the decision or opinion of the National Commission.

Where the new application does not constitute a substantial modification within the meaning of Article L. 752-15 of this Code, it may be submitted directly to the National Commission for Commercial Development.

Article L752-21

Un pétitionnaire dont le projet a été rejeté pour un motif de fond par la Commission nationale d’aménagement commercial ne peut déposer une nouvelle demande d’autorisation sur un même terrain, à moins d’avoir pris en compte les motivations de la décision ou de l’avis de la commission nationale.

Lorsque la nouvelle demande ne constitue pas une modification substantielle au sens de l’article L. 752-15 du présent code, elle peut être déposée directement auprès de la Commission nationale d’aménagement commercial.
