Article L762-11 of the French Monetary and Financial Code

I.-The provisions of the articles mentioned in the left-hand column of the following table shall apply in New Caledonia, subject to the adaptations mentioned in II, in the wording indicated in the right-hand column of the same table:

II.-For the application of I:
1° Article L. 452-1 is amended as follows:
a) In the first paragraph, the words: “even before all the courts” are deleted;
b) The last paragraph is worded as follows:
“The claim referred to in the previous paragraph shall be brought before the Court of First Instance of the registered office of the company in question”;
2° In Article L. 452-2:
a) In the first paragraph, the words: “bring an action for damages before any court” are replaced by the words: “bring a civil action”;
b) In the last paragraph, the last sentence is deleted.

Article L762-11

I.-Sont applicables en Nouvelle-Calédonie, sous réserve des adaptations mentionnées au II, les dispositions des articles mentionnés dans la colonne de gauche du tableau ci-après, dans leur rédaction indiquée dans la colonne de droite du même tableau :

II.-Pour l’application du I :
1° L’article L. 452-1 est ainsi modifié :
a) Au premier alinéa, les mots : « devant toutes les juridictions même » sont supprimés ;
b) Le dernier alinéa est ainsi rédigé :
« La demande mentionnée à l’alinéa précédent est portée devant le tribunal de première instance du siège social de la société en cause. » ;
2° A l’article L. 452-2 :
a) Au premier alinéa, les mots : « agir en réparation devant toute juridiction » sont remplacés par les mots : « se constituer partie civile » ;
b) Au dernier alinéa, la dernière phrase est supprimée.
