Article L774-38 of the French Monetary and Financial Code

I.-Subject to the provisions of II, the articles mentioned in the left-hand column of the following table shall apply in French Polynesia, in the wording indicated in the right-hand column of the same table:

II.For the application of the articles mentioned in the table above:
1° In I of Article L. 548-5, after the words “an insurance contract covering it against the pecuniary consequences of its professional civil liability”, the following words are added: “as provided for by locally applicable insurance provisions”;
2° The decree mentioned in II of the same article is supplemented, where applicable, by locally applicable provisions;
3° In 12° of Article L. 548-6, the following words are added: “mentioned in 4° of Article L. 548-6”. 548-6, the words: “mentioned in 4° of Article L. 1611-7-1 of the General Local Authorities Code ” are replaced by the words: “within the limit of the loan granted by a legal entity to a local authority and its public establishments, with the exception of police and public order missions”.

I.-Sous réserve des dispositions prévues au II, sont applicables en Polynésie française les articles mentionnés dans la colonne de gauche du tableau ci-après, dans leur rédaction indiquée dans la colonne de droite du même tableau :

II.-Pour l’application des articles mentionnés dans le tableau ci-dessus :
1° Au I de l’article L. 548-5, après les mots : « un contrat d’assurances le couvrant contre les conséquences pécuniaires de sa responsabilité civile professionnelle », sont ajoutés les mots : « tel que prévu par les dispositions applicables localement en matière d’assurance, » ;
2° Le décret mentionné au II du même article est complété, le cas échéant, par des dispositions applicables localement ;
3° Au 12° de l’article L. 548-6, les mots : « mentionné au 4° de l’article L. 1611-7-1 du code général des collectivités territoriales » sont remplacés par les mots : « dans la limite du prêt accordé par une personne morale à une collectivité territoriale et à ses établissements publics, à l’exception des missions de police et de maintien de l’ordre public ».
