Administrators in bankruptcy are placed under the supervision of the public prosecutor. In the course of their professional activity, they are subject to inspections entrusted to the public authorities, on the occasion of which they are required to provide any useful information or documents without being able to oppose professional secrecy.
The organisation and procedures of these inspections are determined by decree in the Conseil d’Etat.
As part of the inspections for which the national council mentioned in Article L. 814-2, court-appointed administrators are required, without being able to invoke professional secrecy, to comply with requests from persons responsible for supervision to provide any useful information or documents.
The auditor of the judicial administrator subject to an audit or inspection is required, without being able to oppose professional secrecy, to defer to the requests of the persons responsible for the audit or inspection tending to the communication of any information collected or any document drawn up in the context of the performance of its mission.
The Caisse des dépôts et consignations is required, without being able to invoke professional secrecy, to comply with requests from the persons responsible for the inspection as well as those from the national council mentioned in Article L. 814-2 for the exercise of the control for which it is responsible, seeking the communication of any information or document useful for the knowledge of the movements of funds occurring on the accounts opened in its books in the name of each judicial administrator and of sums deposited there under the mandates to which the inspection or control relates.
At the end of each financial year, judicial administrators draw up a financial statement which they communicate to the Conseil national des administrateurs judiciaires et des mandataires judiciaires, at the latest within six months of the end of the financial year. The content of this financial statement, defined by decree, is adapted depending on whether the administrator keeps cash or commitment accounts.
