Article L811-3 of the French Intellectual Property Code

For its application in the Wallis and Futuna Islands, the French Southern and Antarctic Territories, New Caledonia and Mayotte, Article L. 621-1 of this Code reads as follows:

“Art. L. 621-1:

“The fact, by any director or employee of a company where he is employed, of revealing or attempting to reveal a trade secret is punishable by two years’ imprisonment and a fine of €30,000.

“The court may also impose, as an additional penalty, for a period of up to five years, the disqualification from civic, civil and family rights provided for by the article 131-26 of the Penal Code.”

Pour son application dans les îles de Wallis et Futuna, dans les Terres australes et antarctiques françaises, en Nouvelle-Calédonie et à Mayotte, l’article L. 621-1 du présent code est ainsi rédigé :

“Art. L. 621-1 :

“Le fait, par tout directeur ou salarié d’une entreprise où il est employé, de révéler ou de tenter de révéler un secret de fabrique est puni de deux ans d’emprisonnement et de 30 000 euros d’amende.

“Le tribunal peut également prononcer, à titre de peine complémentaire, pour une durée de cinq ans au plus, l’interdiction des droits civiques, civils et de famille prévue par l’article 131-26 du code pénal.”
