Article L8114-5 of the French Labour Code

The proposed settlement is determined on the basis of the circumstances and seriousness of the offence, the personality of the offender and the offender’s resources and liabilities.

It specifies the amount of the fine to be paid by the offender and, where applicable, the obligations that will be imposed on the offender to put an end to the offence, prevent its recurrence or comply with the obligations to which the offender is subject under this Code or other provisions relating to the employment system. It also sets the deadlines for payment and, where applicable, the fulfilment of the obligations.

A copy of the official report of the offence is attached to the settlement proposal sent to the offender.

La proposition de transaction est déterminée en fonction des circonstances et de la gravité de l’infraction, de la personnalité de son auteur ainsi que de ses ressources et de ses charges.


Elle précise le montant de l’amende transactionnelle que l’auteur de l’infraction devra payer, ainsi que, le cas échéant, les obligations qui lui seront imposées pour faire cesser l’infraction, éviter son renouvellement ou se mettre en conformité avec les obligations auxquelles il est soumis par le présent code ou les autres dispositions relatives au régime du travail. Elle fixe également les délais impartis pour le paiement et, s’il y a lieu, l’exécution des obligations.


Une copie du procès-verbal de constatation de l’infraction est jointe à la proposition de transaction adressée à l’auteur de l’infraction.
