Article L8115-5 of the French Labour Code

Before any decision is taken, the administrative authority informs the person concerned in writing of the penalty envisaged, informing them of the breach of which they are accused and inviting them to submit their observations within a period set by decree in the Conseil d’Etat.

At the end of this period, the administrative authority may, by reasoned decision, impose the fine and issue the corresponding collection order.

It informs the Social and Economic Committee of this decision.

The limitation period for action by the administrative authority to impose an administrative fine for non-compliance is two years from the day on which the non-compliance was committed.

Avant toute décision, l’autorité administrative informe par écrit la personne mise en cause de la sanction envisagée en portant à sa connaissance le manquement retenu à son encontre et en l’invitant à présenter, dans un délai fixé par décret en Conseil d’Etat, ses observations.


A l’issue de ce délai, l’autorité administrative peut, par décision motivée, prononcer l’amende et émettre le titre de perception correspondant.


Elle informe de cette décision le comité social et économique.


Le délai de prescription de l’action de l’autorité administrative pour la sanction du manquement par une amende administrative est de deux années révolues à compter du jour où le manquement a été commis.
