Article L813-3 of the French Code governing the entry and residence of foreign nationals and the right of asylum

The foreign national may only be detained for the time strictly required to examine his or her right of movement or residence and, where applicable, to pronounce and notify the applicable administrative decisions. Detention may not exceed twenty-four hours from the start of the check referred to in article L. 812-2.
In the case provided for in article L. 813-2, the duration of detention carried out for the purposes of identity checks pursuant to article 78-3 of the Code of Criminal Procedure shall count towards the duration of detention for the purposes of checking movement or residence rights.

L’étranger ne peut être retenu que pour le temps strictement exigé par l’examen de son droit de circulation ou de séjour et, le cas échéant, le prononcé et la notification des décisions administratives applicables. La retenue ne peut excéder vingt-quatre heures à compter du début du contrôle mentionné à l’article L. 812-2.
Dans le cas prévu à l’article L. 813-2, la durée de la retenue effectuée aux fins de vérification d’identité en application de l’article 78-3 du code de procédure pénale s’impute sur celle de la retenue pour vérification du droit de circulation ou de séjour.
