I. – Notwithstanding any provision to the contrary, the provisions of this Title are applicable to statutory auditors in the performance of their professional activities, whatever the nature of the engagements or services they provide. They are also applicable to such persons and entities, subject to the rules specific to them, regardless of their legal status.
II. – For the purposes of this Title, the term: “entity” means in particular the funds referred to in Articles L. 214-8, L. 214-24-34 and L. 214-169 of the Monetary and Financial Code.
III. – For the application of this Title, the terms: “public interest entity” mean:
1° The credit institutions mentioned in I of article L. 511-1 of the Monetary and Financial Code having their registered office in France;
2°The insurance and reinsurance undertakings referred to in Articles L. 310-1 and L. 310-1-1 of the Insurance Code, with the exception of mutual insurance companies exempt from administrative authorisation pursuant to Article R. 322-117-1 of the Insurance Code;
3° Provident institutions and their unions governed by Title III of Book IX of the Social Security Code, with the exception of those mentioned in 3° of Article L. 931-6-1 of the Social Security Code;
4° Mutual societies and unions of mutual societies governed by Book II of the Mutual Code, with the exception of those mentioned in 3° of Article L. 211-11 du code de la mutualité;
5° Persons and entities whose financial securities are admitted to trading on a regulated market;
6° Where their consolidated or combined balance sheet total exceeds a threshold set by decree:
a) Financial holding companies within the meaning of Article L. 517-1 of the Monetary and Financial Code, one of whose subsidiaries is a credit institution;
b) Mixed financial holding companies within the meaning of Article L. 517-4 of the Monetary and Financial Code, one of whose subsidiaries is a public interest entity within the meaning of this article;
c) Insurance group companies within the meaning of article L. 322-1-2 of the Insurance Code;
d) Mutual insurance group companies within the meaning of Article L. 322-1-3 of the Insurance Code;
e) Mutual group unions within the meaning of Article L. 111-4-2 du code de la mutualité;
f) Social protection insurance group companies within the meaning of Article L. 931-2-2 du code de la sécurité sociale.
7° Supplementary occupational pension funds mentioned in article L. 381-1 du code des assurances;
8° Les mutuelles ou unions de retraite professionnelle supplémentaire mentionnés à l’article L. 214-1 du code de la mutualité;
9° Institutions for supplementary professional retirement mentioned in article L. 942-1 of the Social Security Code.
