Article L821-2 of the French Code governing the entry and residence of foreign nationals and the right of asylum

It is punishable by one year’s imprisonment, a fine of €3,750 and a three-year ban from French territory for, for a foreign national who has been checked when crossing the border from a country that is not a party to the Convention signed in Schengen on 19 June 1990 without fulfilling the entry conditions provided for in Article 6 of Regulation (EU) 2016/399 of the European Parliament and of the Council of 9 March 2016 on a Union Code on the rules governing the movement of persons across borders (Schengen Borders Code) or in Article L. 311-1, to refuse to submit to fingerprinting and photographing operations in the case provided for in 3° of Article L. 142-1.

Est puni d’un an d’emprisonnement, de 3 750 euros d’amende et de trois ans d’interdiction du territoire français le fait, pour un étranger ayant été contrôlé à l’occasion du franchissement de la frontière en provenance d’un pays tiers aux Etats parties à la convention signée à Schengen le 19 juin 1990 sans remplir les conditions d’entrée prévues à l’article 6 du règlement (UE) 2016/399 du Parlement européen et du Conseil du 9 mars 2016 concernant un code de l’Union relatif au régime de franchissement des frontières par les personnes (code frontières Schengen) ou à l’article L. 311-1, de refuser de se soumettre aux opérations de relevé des empreintes digitales et de prise de photographie dans le cas prévu au 3° de l’article L. 142-1.
