Article L8222-1 of the French Labour Code

When a contract is concluded, the subject of which is an obligation of a minimum amount with a view to the performance of work, the supply of services or the carrying out of a commercial act, and periodically until the end of the performance of the contract, any person shall check that his co-contractor is complying with:

1° the formalities referred to in articles L. 8221-3 and L. 8221-5;

2° only one of the formalities mentioned in 1°, in the case of a contract concluded by a private individual for his personal use, that of his spouse, partner in a civil solidarity pact, cohabitee, ascendants or descendants.

The procedures for carrying out the checks required by this article shall be specified by decree.

Article L8222-1

Toute personne vérifie lors de la conclusion d’un contrat dont l’objet porte sur une obligation d’un montant minimum en vue de l’exécution d’un travail, de la fourniture d’une prestation de services ou de l’accomplissement d’un acte de commerce, et périodiquement jusqu’à la fin de l’exécution du contrat, que son cocontractant s’acquitte :

1° des formalités mentionnées aux articles L. 8221-3 et L. 8221-5 ;

2° de l’une seulement des formalités mentionnées au 1°, dans le cas d’un contrat conclu par un particulier pour son usage personnel, celui de son conjoint, partenaire lié par un pacte civil de solidarité, concubin, de ses ascendants ou descendants.

Les modalités selon lesquelles sont opérées les vérifications imposées par le présent article sont précisées par décret.
