Article L823-10 of the French Code governing the entry and residence of foreign nationals and the right of asylum

For the application of the second paragraph of article L. 823-1 and article L. 823-2, the illegal situation of the foreign national is assessed in the light of the legislation of the State party concerned. Furthermore, proceedings may only be brought against the offender on the basis of an official report or a certificate from the competent authorities of the State party concerned.
No proceedings may be brought against a person who can prove that he or she has been finally tried abroad for the same acts and, in the event of conviction, that the sentence has been served or is time-barred.

Article L823-10

Pour l’application du second alinéa de l’article L. 823-1 et de l’article L. 823-2, la situation irrégulière de l’étranger est appréciée au regard de la législation de l’Etat partie intéressé. En outre, les poursuites ne peuvent être exercées à l’encontre de l’auteur de l’infraction que sur une dénonciation officielle ou sur une attestation des autorités compétentes de l’Etat partie intéressé.
Aucune poursuite ne peut être exercée contre une personne justifiant qu’elle a été jugée définitivement à l’étranger pour les mêmes faits et, en cas de condamnation, que la peine a été subie ou prescrite.
