Article L823-2 of the French Code governing the entry and residence of foreign nationals and the right of asylum

Subject to the exemptions provided for in Article L. 823-9, it is punishable by five years’ imprisonment and a fine of €30,000 for any person to facilitate or attempt to facilitate the unlawful entry, movement or residence of a foreign national:
1° On the territory of another State party to the Schengen Convention signed on 19 June 1990;
2° On the territory of another State party to the Protocol against the Smuggling of Migrants by Land, Sea and Air, supplementing the United Nations Convention against Transnational Organised Crime, signed in Palermo on 12 December 2000.
The provisions of 2° apply from the date of publication of this protocol in the Official Journal of the French Republic.

Sous réserve des exemptions prévues à l’article L. 823-9, est puni de cinq ans d’emprisonnement et de 30 000 euros d’amende le fait, pour toute personne, de faciliter ou de tenter de faciliter l’entrée, la circulation ou le séjour irréguliers d’un étranger :
1° Sur le territoire d’un autre État partie à la convention signée à Schengen le 19 juin 1990 ;
2° Sur le territoire d’un autre État partie au protocole contre le trafic illicite de migrants par terre, air et mer, additionnel à la convention des Nations unies contre la criminalité transnationale organisée, signée à Palerme le 12 décembre 2000.
Les dispositions du 2° sont applicables à compter de la date de publication de ce protocole au Journal officiel de la République française.
