Article L8271-17 of the French Labour Code

In addition to the labour inspectors referred to in article L. 8112-1, officers and agents of the criminal investigation department, officers of the customs department and officers of the Conseil national des activités privées de sécurité (National Council for Private Security Activities) commissioned by its director and sworn in are responsible for investigating and recording, by means of reports sent directly to the public prosecutor, breaches of the provisions of article L. 8251-1 relating to the employment of a foreigner not authorised to work and article L. 8251-2 prohibiting the use of the services of an employer of a foreigner not authorised to work.

In order to enable the special contribution mentioned in article L. 8253-1 of this Code and the flat-rate contribution mentioned in article L. 822-2 of the Code on the Entry and Residence of Foreigners and the Right of Asylum to be paid, the Director General of the French Office for Immigration and Integration receives a copy of the official reports relating to these offences from the agents mentioned in the first paragraph of this article.

Outre les agents de contrôle de l’inspection du travail mentionnés à l’article L. 8112-1, les agents et officiers de police judiciaire, les agents de la direction générale des douanes et les agents du Conseil national des activités privées de sécurité commissionnés par son directeur et assermentés sont compétents pour rechercher et constater, au moyen de procès-verbaux transmis directement au procureur de la République, les infractions aux dispositions de l’article L. 8251-1 relatif à l’emploi d’un étranger non autorisé à travailler et de l’article L. 8251-2 interdisant le recours aux services d’un employeur d’un étranger non autorisé à travailler.

Afin de permettre la liquidation de la contribution spéciale mentionnée à l’article L. 8253-1 du présent code et de la contribution forfaitaire mentionnée à l’article L. 822-2 du code de l’entrée et du séjour des étrangers et du droit d’asile, le directeur général de l’Office français de l’immigration et de l’intégration reçoit des agents mentionnés au premier alinéa du présent article une copie des procès-verbaux relatifs à ces infractions.
