The enforcement officers referred to in Article L. 8271-1-2 are empowered to interview, at any place and with their consent, any employer or his representative and any person paid, having been paid or presumed to be or to have been paid by the employer or by a self-employed person, in order to ascertain the nature of that person’s activities, his conditions of employment and the amount of the remuneration relating thereto, including benefits in kind. They may also interview any person likely to be able to provide information useful in carrying out their task of combating illegal employment.
In accordance with article 28 of the Code of Criminal Procedure, article 61-1 of the same code is applicable when a person is interviewed in respect of whom there are reasonable grounds for suspecting that he has committed or attempted to commit an offence.
These interviews may be recorded in minutes signed by the officers mentioned in the first paragraph and the persons interviewed.
These officers are also authorised to ask employers, the self-employed, persons employed in the company or at the workplace and any person whose statements they take in the course of their duties to provide proof of their identity and address.
