For the application of this book in Guadeloupe, French Guiana, Martinique, Réunion, Mayotte and Saint-Pierre-et-Miquelon:
1° In Article L. 812-2, the words: “Articles 78-1 to 78-2-2 of the Code of Criminal Procedure” are replaced by the words: “Article 78-1, Article 78-2 with the exception of its ninth and tenth paragraphs and Articles 78-2-1 and 78-2-2 of the Code of Criminal Procedure”;
2° Article L. 821-1 reads as follows:
“Art. L. 821-1 -A foreigner entering Guadeloupe, French Guiana, Martinique, Réunion, Mayotte or Saint-Pierre-et-Miquelon without complying with the provisions of Article L. 311-1 of this Code is punishable by one year’s imprisonment and a fine of €3,750. ” For the application of this article, public action may only be initiated when the facts have been established in the circumstances set out in Article 53 of the Code of Criminal Procedure. “;
3° Article L. 821-2 reads as follows:
“Art. L. 821-2 -If a foreign national who does not meet the entry conditions provided for in Article L. 311-1 refuses to submit to fingerprinting and photographing operations in the case provided for in 3° of Article L. 142-1, the offence is punishable by one year’s imprisonment, a fine of €3,750 and a three-year ban from French territory. “
