Article L835-2 of the French Code governing the entry and residence of foreign nationals and the right of asylum

For the application of this book in French Polynesia:
1° In Title I, the word “France” is replaced by the words “French Polynesia”;
2° Monetary values expressed in euros are replaced by their equivalent in CFP francs;
3° In Article L. 812-2, the provisions of 3° do not apply and the words: “Articles 78-1 to 78-2-2 of the Code of Criminal Procedure” are replaced by the words: “Article 78-1, Article 78-2 with the exception of its ninth and tenth paragraphs and Articles 78-2-1 and 78-2-2 of the Code of Criminal Procedure”;
4° In Article L. 820-1, the references to Articles L. 822-4, L. 822-5 and L. 823-1 to L. 823-7 are deleted;
5° Article L. 821-1 reads as follows:

“Art. L. 821-1 -A foreigner entering or staying in French Polynesia without complying with the provisions of Articles L. 311-1 and L. 411-1 or remaining there beyond the period authorised by his or her visa is punishable by one year’s imprisonment and a fine of €3,750.
“The court may also, as an additional penalty, prohibit the convicted person, for a period that may not exceed three years, from entering or staying on the territory of French Polynesia. “;

6° Article L. 821-2 reads as follows:

“Art. L. 821-2 -If a foreign national who does not meet the entry conditions provided for in Article L. 311-1 refuses to submit to fingerprinting and photographing operations in the case provided for in 3° of Article L. 142-1, he or she shall be liable to one year’s imprisonment, a fine of €3,750 and a three-year ban from French territory. “;

7° In Article L. 822-2, the words: “and the special contribution provided for in Article L. 8253-1 of the Labour Code” are deleted;
8° Article L. 822-3 reads as follows:

“Art. L. 822-3-The total amount of pecuniary penalties for employing an illegally staying foreigner may not exceed the amount of the criminal penalties provided for by the locally applicable provisions relating to the employment of foreign labour or, if the employer falls within the scope of these articles, the amount of the criminal penalties provided for in Articles L. 823-1 to L. 823-10 of this code. “;

9° In Article L. 822-5, after the words: “In this respect, it”, the words: “establishes, sets the amount of the contribution,” are inserted.

Pour l’application du présent livre en Polynésie française :
1° Au titre Ier, le mot : ” France ” est remplacé par les mots : ” Polynésie française ” ;
2° Les valeurs monétaires exprimées en euros sont remplacées par leur contre-valeur en francs CFP ;
3° A l’article L. 812-2, les dispositions du 3° ne sont pas applicables et les mots : ” des articles 78-1 à 78-2-2 du code de procédure pénale ” sont remplacés par les mots : ” de l’article 78-1, de l’article 78-2 à l’exception de ses neuvième et dixième alinéas et des articles 78-2-1 et 78-2-2 du code de procédure pénale ” ;
4° A l’article L. 820-1, les références aux articles L. 822-4, L. 822-5 et L. 823-1 à L. 823-7 sont supprimées ;
5° L’article L. 821-1 est ainsi rédigé :

” Art. L. 821-1.-Est puni d’un an d’emprisonnement et de 3 750 euros d’amende, le fait pour un étranger de pénétrer ou de séjourner en Polynésie française sans se conformer aux dispositions des articles L. 311-1 et L. 411-1 ou de s’y maintenir au-delà de la durée autorisée par son visa.
” La juridiction pourra en outre, à titre de peine complémentaire, interdire au condamné, pendant une durée qui ne peut excéder trois ans, de pénétrer ou de séjourner sur le territoire de la Polynésie française. ” ;

6° L’article L. 821-2 est ainsi rédigé :

” Art. L. 821-2.-Est puni d’un an d’emprisonnement, de 3 750 euros d’amende et de trois ans d’interdiction du territoire français le fait pour un étranger qui ne remplit pas les conditions d’entrée prévues à l’article L. 311-1, de refuser de se soumettre aux opérations de relevé des empreintes digitales et de prise de photographie dans le cas prévu au 3° de l’article L. 142-1. ” ;

7° A l’article L. 822-2, les mots : ” et de la contribution spéciale prévue à l’article L. 8253-1 du code du travail ” sont supprimés ;
8° L’article L. 822-3 est ainsi rédigé :

” Art. L. 822-3.-Le montant total des sanctions pécuniaires pour l’emploi d’un étranger en situation de séjour irrégulier ne peut excéder le montant des sanctions pénales prévues par les dispositions applicables localement relatives à l’emploi de la main-d’œuvre étrangère ou, si l’employeur entre dans le champ d’application de ces articles, le montant des sanctions pénales prévues aux articles L. 823-1 à L. 823-10 du présent code. ” ;

9° A l’article L. 822-5, après les mots : ” A ce titre, il “, sont insérés les mots : ” constate, fixe le montant de la contribution, “.
