Article LO4435-6 of the French General Code of Local Authorities

Authorisation is granted by law when the request concerns the adaptation of a legislative provision. In this case, it also constitutes authorisation to make the implementing regulatory provisions.

It is granted by decree in the Council of State when the request relates solely to the adaptation of a regulatory provision.

It is granted for a period that may not extend beyond the renewal of the regional council.

L’habilitation est accordée par la loi lorsque la demande porte sur l’adaptation d’une disposition législative. Dans ce cas, elle vaut également habilitation à prendre les dispositions réglementaires d’application.

Elle est accordée par décret en Conseil d’Etat lorsque la demande ne porte que sur l’adaptation d’une disposition réglementaire.

Elle est accordée pour une durée ne pouvant aller au-delà du renouvellement du conseil régional.
