The acts taken by the authorities of the collectivity are enforceable by operation of law as soon as they have been published in the Official Journal of Saint-Barthélemy, posted or notified to the interested parties and sent to the representative of the State. However, the acts mentioned in Article LO 6251-2 may only come into force upon the expiry of a period of fifteen days from their transmission to the State representative.
The publication or posting of these acts is also organised, on a complementary but non-exclusive basis, in digital form.
The President of the Territorial Council certifies, under his responsibility, the enforceability of these acts.
The transmission of the acts mentioned in this article may be carried out by any means, including by electronic means in accordance with procedures laid down by decree in the Conseil d’Etat.
Proof of receipt of documents by the State representative may be provided by any means. The acknowledgement of receipt, which is issued immediately, may be used for this purpose but is not a condition of the enforceability of the acts.
