Article LO6252-19 of the French General Code of Local Authorities

In the areas of competence of the collectivity, the President of the Territorial Council may, after deliberation by the Executive Council, negotiate, in compliance with France’s international commitments, administrative arrangements with the administrations of any State or territory of America or the Caribbean, with a view to promoting the economic, social and cultural development of Saint-Barthélemy.

The authorities of the Republic competent in matters of foreign policy are informed of the intention of the President of the Territorial Council to negotiate and, at their request, represented at the negotiation within the Saint-Barthélemy delegation. They have a period of one month from notification of the intention to negotiate to oppose the negotiation of the administrative arrangements.

The competent authorities of the Republic may entrust the President of the Territorial Council with the powers to sign the administrative arrangements on behalf of the Republic.

These administrative arrangements are then submitted to the Territorial Council for deliberation. They come into force as soon as they are transmitted to the State representative under the conditions set out in article LO 6241-1.

Dans les domaines de compétence de la collectivité, le président du conseil territorial peut, après délibération du conseil exécutif, négocier, dans le respect des engagements internationaux de la France, des arrangements administratifs avec les administrations de tout Etat ou territoire d’Amérique ou de la Caraïbe, en vue de favoriser le développement économique, social et culturel de Saint-Barthélemy.

Les autorités de la République compétentes en matière de politique étrangère sont informées de l’intention du président du conseil territorial de négocier et, à leur demande, représentées à la négociation au sein de la délégation de Saint-Barthélemy. Elles disposent d’un délai d’un mois à compter de la notification de l’intention de négocier pour s’opposer à la négociation des arrangements administratifs.

Les autorités compétentes de la République peuvent confier au président du conseil territorial les pouvoirs lui permettant de signer les arrangements administratifs au nom de la République.

Ces arrangements administratifs sont ensuite soumis à la délibération du conseil territorial. Ils entrent en vigueur dès leur transmission au représentant de l’Etat dans les conditions fixées à l’article LO 6241-1.
