In the areas of competence of the collectivity, the President of the Territorial Council may, after deliberation by the Executive Council, negotiate, in compliance with France’s international commitments, administrative arrangements with the administrations of any State or territory of America or the Caribbean, with a view to promoting the economic, social and cultural development of Saint-Barthélemy.
The authorities of the Republic competent in matters of foreign policy are informed of the intention of the President of the Territorial Council to negotiate and, at their request, represented at the negotiation within the Saint-Barthélemy delegation. They have a period of one month from notification of the intention to negotiate to oppose the negotiation of the administrative arrangements.
The competent authorities of the Republic may entrust the President of the Territorial Council with the powers to sign the administrative arrangements on behalf of the Republic.
These administrative arrangements are then submitted to the Territorial Council for deliberation. They come into force as soon as they are transmitted to the State representative under the conditions set out in article LO 6241-1.
