Article LO6261-7 of the French General Code of Local Authorities

The surplus from the operating section generated in respect of the financial year ended, together with the previous result carried forward, is allocated in full as soon as the nearest budgetary decision is taken following the approval of the administrative account and, in any event, before the close of the following financial year.

The decision to allocate taken by the deliberative assembly is produced in support of the budgetary decision to take back the result.

The deficit in the operating section, the financing requirement or the surplus in the investment section are taken back in full at the earliest budgetary decision following the vote on the administrative account and, in any event, before the close of the following financial year.

Le résultat excédentaire de la section de fonctionnement dégagé au titre de l’exercice clos, cumulé avec le résultat antérieur reporté, est affecté en totalité dès la plus proche décision budgétaire suivant le vote du compte administratif et, en tout état de cause, avant la clôture de l’exercice suivant.

La délibération d’affectation prise par l’assemblée délibérante est produite à l’appui de la décision budgétaire de reprise du résultat.

Le résultat déficitaire de la section de fonctionnement, le besoin de financement ou l’excédent de la section d’investissement sont repris en totalité dès la plus proche décision budgétaire suivant le vote du compte administratif et, en tout état de cause, avant la clôture de l’exercice suivant.
