Article LO6262-7 of the French General Code of Local Authorities

As from the referral to the territorial audit chamber and until the end of the procedure provided for in article LO 6262-4, the Territorial Council may not vote on budgetary matters, except for the deliberation provided for in the second paragraph of the same Article LO 6262-4 and for the application of Article LO 6262-10.

When the local authority’s budget has been settled and made enforceable by the representative of the State, the supplementary budgets relating to the same financial year are forwarded by the representative of the State to the territorial audit chamber. In addition, the vote of the deliberative body on the administrative account provided for in article LO 6262-10 takes place before the vote on the initial budget for the following financial year. When the administrative account adopted under the above-mentioned conditions shows a deficit in the implementation of the budget, this deficit is carried forward to the initial budget for the following financial year. This initial budget is forwarded to the territorial audit chamber by the State representative.

If the procedure defined in the previous paragraph is applied, the dates set out in the first paragraph of article LO 6262-2 for the adoption of the primary budget are postponed to 1st June and 15th June respectively. In this case, the deadline for the transmission of the accounting officer’s management report provided for in article LO 6262-10 is brought back to 1st May.

A compter de la saisine de la chambre territoriale des comptes et jusqu’au terme de la procédure prévue à l’article LO 6262-4, le conseil territorial ne peut se prononcer en matière budgétaire, sauf pour la délibération prévue au deuxième alinéa du même article LO 6262-4 et pour l’application de l’article LO 6262-10.

Lorsque le budget de la collectivité a été réglé et rendu exécutoire par le représentant de l’Etat, les budgets supplémentaires afférents au même exercice sont transmis par le représentant de l’Etat à la chambre territoriale des comptes. En outre, le vote de l’organe délibérant sur le compte administratif prévu à l’article LO 6262-10 intervient avant le vote du budget primitif afférent à l’exercice suivant. Lorsque le compte administratif adopté dans les conditions ci-dessus mentionnées fait apparaître un déficit dans l’exécution du budget, ce déficit est reporté au budget primitif de l’exercice suivant. Ce budget primitif est transmis à la chambre territoriale des comptes par le représentant de l’Etat.

S’il est fait application de la procédure définie à l’alinéa précédent, les dates fixées au premier alinéa de l’article LO 6262-2 pour l’adoption du budget primitif sont reportées respectivement au 1er juin et au 15 juin. Dans ce cas, le délai limite de la transmission du compte de gestion du comptable prévu à l’article LO 6262-10 est ramené au 1er mai.
