Article LO6271-6 of the French General Code of Local Authorities

The costs corresponding to the exercise of transferred powers are subject to an assessment prior to the transfer of said powers.

A consultative commission for the assessment of costs is created in the collectivity of Saint-Barthélemy, chaired by a magistrate from the Chambre territoriale des comptes and made up equally of representatives from the State and the collectivity of Saint-Barthélemy. It is consulted on the methods of compensation for the costs corresponding to the transferred powers.

The amount of expenditure resulting from the increased costs is established by a joint order of the minister responsible for the budget and the minister responsible for overseas France, following the opinion of the commission established by the present article.

Les charges correspondant à l’exercice des compétences transférées font l’objet d’une évaluation préalable au transfert desdites compétences.

Il est créé dans la collectivité de Saint-Barthélemy une commission consultative d’évaluation des charges présidée par un magistrat de la chambre territoriale des comptes et composée à parité de représentants de l’Etat et de la collectivité de Saint-Barthélemy. Elle est consultée sur les modalités de compensation des charges correspondant aux compétences transférées.

Le montant des dépenses résultant des accroissements de charges est constaté par arrêté conjoint du ministre chargé du budget et du ministre chargé de l’outre-mer, après avis de la commission instituée par le présent article.
